HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO Criminal Petition No.6914 of 2017 ORDER :
Heard the learned counsel for the petitioner/ accused in C.C.No.746 of 2012 pending on the file of the Principal Judicial Magistrate of First Class, Miryalaguda, based on the private complaint of the 2nd respondent for the offence punishable u/ sec.138 of the Negotiable Instruments Act, and also the learned counsel for the 2nd respondent and the learned Public Prosecutor for the 1st respondent-State and perused the grounds urged in the quash petition. It is impugning the non-bailable warrant (NBW) issued by the learned Magistrate and the dismissal of the same by docket order dated 17.03.2017 when sought for recall. Now it is the submission by both sides that the petitioner is already taken to custody pursuant to the execution of the NBW supra. Needless to say the petitioner has to execute a self bond as contemplated by Section 88CrPC with or without sureties and the learned Magistrate to consider for his release on his undertaking for future appearance.
Having regard to the above and in the result, the Criminal Petition is disposed of. Consequently, pending miscellaneous petitions, if any, shall stand closed.
