THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NOS.6610 OF 2022, 6611 OF 2022 AND 6612 OF 2022 COMMON ORDER:
These three Criminal Petitions are filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners who are arrayed as Accused Nos.4, 15, 16, 20, 28, 30, 33, 34, 35, 39, 40, 48, 53, 60, 61 and 68 in Crime No.227 of 2022 on the file of RPS, Secunderabad registered for the offences punishable under Sections 143, 147, 324, 307, 435, 427, 448, 336, 332, 341, 120(B) and 201 read with Section 149 of Indian Penal Code and Sections 150, 151 and 152 of Indian Railway Act and Section 3 of PDPP Act and Section 174 of Cr.P.C.

As the crime number in these three criminal petitions is one and the same and the petitioners are Accused Nos.4, 15, 16, 20, 28, 30, 33, 34, 35, 39, 40, 48, 53, 60, 61 and 68, the criminal petitions are heard together and disposed off by way of this common order.

Heard learned counsel for the petitioners/Accused and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The facts of the case are that the petitioners and others are alleged to be a part of mob which set fire to railway coaches and broke glasses in the railway station, that being part of agitation carried out by several hundreds of students.

Learned counsel for the petitioners submits that the petitioners are students and they are is in jail since one and half month.

Learned Assistant Public Prosecutor opposed the bail applications.

In the said circumstances, the petitioners who are students are in jail since one and half month and as seen from the remand case diary so far 43 witnesses were examined, this Court deems it appropriate to grant the relief of regular bail to these petitioners. 8.
Accordingly, these Criminal Petitions are allowed and the petitioners/Accused Nos.4, 15, 16, 20, 28, 30, 33, 34, 35, 39, 40, 48, 53, 60, 61 and 68 are granted bail subject to the following conditions:
i) The petitioners/Accused Nos.4, 15, 16, 20, 28, 30, 33, 34, 35, 39, 40, 48, 53, 60, 61 and 68 shall execute personal bonds for a sum of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties for a like sum each to the satisfaction of Metropolitan Sessions Judge, Nampally, Hyderabad (made over to) Special Judge for Trial of Offences under SCs and STs (POA) Act-cum-VI Additional Metropolitan Sessions Judge, Secunderabad. ii) The petitioners/Accused Nos.4, 15, 16, 20, 28, 30, 33, 34, 35, 39, 40, 48, 53, 60, 61 and 68 shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of three (03) months and thereafter as and when required.
iii) The petitioners/Accused Nos.4, 15, 16, 20, 28, 30, 33, 34, 35, 39, 40, 48, 53, 60, 61 and 68 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 01.08.2022 ns
