THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.8611 of 2004 ORDER:

This writ petition is filed under Article 226 of the Constitution of India to issue an appropriate writ, order or direction, declaring the action of the respondent in not releasing the gratuity, provident fund and dearness allowance amounts payable to petitioner, as arbitrary, illegal, non-exercise of power, apart from contrary to the exemptions given under Section 60 of CPC and violative of the Fundamental Right guaranteed under Article 19 of the Constitution of India and consequently direct the respondent to forthwith release petitioner's gratuity, provident fund and dearness allowance amounts lying with the garnishee respondent.

2. The learned counsel for both the parties, in one voice, submitted that the respondent has already released the retrial benefits of the petitioner. In view of the submission made by the learned counsel for both the parties, no further orders are necessary in this writ petition.

3. Hence, the writ petition is closed. Miscellaneous petitions if any pending in this writ petition shall stand closed. __________________________ (T.SUNIL CHOWDARY, J) March 29, 2016.
