HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.43705 of 2016 ORDER:

The present writ petition is filed by the petitioner seeking to declare the action of the 3rd respondent in harassing the petitioner by summoning him o the police station, thereby threatening to implicate the petitioner and his family members in false cases, at the instigation of the 4threspondnet, as illegal and arbitrary, and consequently, direct the 3rd respondent not to interfere with the disputes related to money, which are civil in nature.

Heard and perused the material available on record. The case of the petitioner is that there are money disputes, which are civil in nature, between him and the 4th respondent and at the instigation of the 4th respondent, the 3rd respondent is summoning him to the police station and pressurizing him to settle the issue with the 4th respondent otherwise, he will be implicated in false criminal cases. Learned Assistant Government Pleader for Home submitted that the respondent police are not intending to interfere with the civil disputes.

Considering the circumstances of the case, without expressing any opinion on merits, the Writ Petition is disposed of with the following direction:

" The 3rd respondent is directed not to interfere with the affairs of the petitioner and the 4th respondent, more particularly, with the civil disputes pending between them. However, this order will not stand in the way of the

3rd respondent to register a case, if any complaint is lodged against the petitioner for cognizable offence." There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ______________ RAJA ELANGO, J December 16, 2016.
