HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.15483 OF 2002 ORDER:

This writ petition is filed seeking to issue a writ of Mandamus directing the 1st respondent to pay the differential amount of subsistence allowance at the rate of 25% of the petitioner's salary with effect from 11.1.1999 till 11.8.2002 and pay the subsistence allowance at the rate of 75% with effect from 12.8.2002 onwards till the date of completion of the disciplinary proceedings or till reinstatement, after declaring the action of the 1st respondent in not paying the subsistence allowance at the rate of 75% of the monthly salary from the date of expiry of six months from the date of suspension, as illegal and arbitrary.

Heard Sri B. Sudhakar Reddy, learned Counsel for the petitioner and the learned Government Pleader for Industries and Commerce.

When this matter is taken up for hearing, it is noticed that the petitioner has attained the age of superannuation. If he has any grievance in respect of subsistence allowance, he is at liberty to submit a representation to the respondents within one week from the date of receipt of a copy of this order. On such representation being received, the respondents shall consider

the same and pass appropriate orders within a period of four weeks thereafter.

With the above observation, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
