HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION Nos.7257 and 7263 of 2017 COMMON ORDER:

Heard learned counsel for the petitioners/accused Nos.1 to 11 in Crime No.301 of 2017 of Sircilla Police Station, Rajanna Sircilla District, registered for the offences punishable under Sections 143, 147, 353, 186 189, 504 r/w 149 IPC and Crime No.300 of 2017 of Sircilla Police Station, Rajanna Siricilla District registered for the offences punishable under Sections 143, 147, 341, 353 r/w 149 IPC and also heard learned public prosecutor representing the 1st respondent-State and perused the grounds urged in the quash petitions and the contents of FIRs. 2) Among the two FIRs, so far as the offence under Section 186 IPC, there is a bar for registration of the crime by police under Section 195 Cr.P.C to take cognizance and the offence under Section 353 IPC is punishable for two years, which is nonbailable but the other offences are bailable.

3) Having regard to the above, the Criminal Petitions are disposed of for nothing to interdict the investigation but for not to arrest the petitioners pending investigation. However, it does not prevent the police to secure the presence of the petitioners for the purpose of investigation. Further remedies are left open to the petitioners after filing police final report and any cognizance taken therefrom.

4) Pending miscellaneous petitions, if any, shall stand closed.
