ORDER

This writ petition is filed seeking the following relief: "......to issue an appropriate Writ, Order or direction preferably one in the nature of Writ of Mandamus and to declare the action of the respondents in not considering the case of the petitioner for appointment as a Senior Mate in Appaipally Grampanchayat as per the seniority list dt 05.01.2019 of Senior Mates in the Appaipally Grampanchayat in Lingala Mandal, Nagarkurnool District, is highly illegal, arbitrary, unreasonable, discriminatory and also in violation of Articles 14, 16 and 21 of the Constitution of India and declare the same as bad in law and consequently direct the respondents to consider the case of the petitioner for appointment as a Senior Mate as per the seniority list dated 05.01.2019 in Appaipally Grampanchayat in Lingala Mandal, Nagarkurnool District and to pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case."

Heard Sri C.Raja Sekhar Reddy, learned counsel appearing for the petitioner, learned Government Pleader for Panchayat Raj and Rural Development appearing for respondent Nos. 1 to 3 and Smt Padma Rekha, learned Standing Counsel appearing for respondent No.4.

The petitioner is working as Card Holder since 10 years with the respondents. As per the seniority list maintained by the respondents, the petitioner is fully eligible to be appointed to the next higher post of Senior Mate. When the respondents are not considering the case of the petitioner for the post of Senior Mate, he submitted a representation dated 1.8.2019 to the respondents. But, so far, no orders have been passed thereon.

Learned counsel appearing for the petitioner submits that appropriate orders be passed in the writ petition by directing the respondents to consider the representation dated 1.8.2019 submitted by the petitioner.

Learned Government Pleader appearing for the respondents contends that the since the representation submitted by the petitioner is pending before the 2nd respondent, the 2nd respondent would consider and pass appropriate orders in accordance with law.

Having considered the rival submissions made by the learned counsel on either side, this Court is of the view that this Writ Petition can be disposed of directing the 2nd respondent to consider the representation dated 1.8.2019 submitted by the petitioner and pass appropriate orders

thereon, in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. Accordingly, the Writ Petition is disposed of. No costs. Pending miscellaneous petitions, if any, shall stand closed.
