THE HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 39323 OF 2016 O R D E R:

Heard Sri P. Nagendra Reddy for petitioner and learned Government Pleader (Land Acquisition) for respondents. The petitioner prays for mandamus declaring the action of respondents in intending to lay pipelines through agricultural land in Survey No. 100, Gummadavalli Village, Kandukur Mandal, Ranga Reddy District, without recourse to law, as illegal, arbitrary and unconstitutional.

The Government Pleader for Land Acquisition, on instructions, makes a statement that the respondents are either taking consent of the land owner or in the alternative, issuing notification before undertaking the work not only at the petition land but all along the execution of RWS work. Unless and until the options referred to above are considered, the grievance of petitioner shall have to be merely treated as an apprehension. The statement is placed on record.

The Writ Petition is disposed of and respondents are given liberty either to take consent or proceed in accordance with law for laying pipeline through Survey No.100, Gummadavalli Village, Kandukur Mandal, Ranga Reddy District. No costs. Consequently, the miscellaneous applications, if any shall stand closed.
