HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.33665 of 2011 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Revenue.

The writ petition is filed seeking issuance of Writ of Mandamus declaring the action of respondent in not considering the representation of the petitioner dated 04-11-2011 for allotment of house site in survey No.445/2, 476, 469/2B at Dinnedevarapadu Village, Kurnool Mandal and District in terms of the recommendation made by the A.P.Government Press Employees Cooperative House Building Society as illegal and arbitrary.

The husband of the petitioner was a binder in Government Press, Kurnool and while he was in service, he along with other employees of the said press formed the Government Press Employees Cooperative House Building Society (Society) vide registration P.No.1404. Pursuant to an application made by the Society, the respondents i.e. District Collector and others agreed to assign land in survey Nos.445/2, 476, 469/2B admeasuring Ac.39-39 cents at Dinnedevarapdu Village, Kurnool Mandal and District as house plots. Accordingly, the husband of the petitioner remitted the requisite amount in favour of the Government vide challan No.1042 dated 0811-1982 for Rs.55/- and challan No.2766, dated 16-01-1984 for Rs.55/- . The revenue authorities conducted a lucky dip for allotment of house site plots in favour of the employees of Government press.

It is stated that the 2nd respondent did not include the name of petitioner's husband in the list of beneficiaries and as such, no plot was allotted to him. Though the husband of the petitioner made several requests about the same, so far, there is no response from the respondents.

An enquiry came to be conducted by the authorities, wherein, it was noticed that some of the employees of the Government press were allotted two house site plots and some were not allotted even a single house site plot. In view of the above, the petitioner made a representation dated 04-11-2011 to the respondents seeking allotment of the plot by canceling allotment of double plots. Since no order was passed on the said representation, the present writ petition came to be filed.

Without going into the merits and having regard to the circumstances stated above, the writ petition is disposed of by directing the 3rd respondent to pass orders on the representation dated 04-11-2011 made by the petitioner, if the same is still pending, in accordance with law within eight weeks from the date of receipt of the order.

As a sequel thereto, Miscellaneous Petitions, if any, pending shall stand closed.
