THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR Writ Appeal No.79 of 2015 Judgment:(per the Hon'ble the Chief Justice Sri Kalyan Jyoti Sengupta)) The writ petition, in our view, has rightly been dismissed by the learned Single Judge as we feel on the following reasons, the writ petition should not be entertained. It has not been done rightly so.
The appellant-writ petitioner is a third party and he made a complaint that the unofficial respondent has produced fake and false Scheduled Tribe Certificate, on the strength of which, he secured a job. On receipt of the complaint, disciplinary action has been taken. Once disciplinary action has been taken on any ground pursuant to the complaint, it is for the employer and the employee concerned and not for the third parties to speak anything more. The contention of the writ petitioner appears to be an individual one.
The writ appeal is accordingly dismissed.
Pending miscellaneous petitions shall also stand closed. No order as to costs.
