THE HON'BLE SRI JUSTICE R. SUBHASH REDDY AND THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA WRIT APPEAL No.926 OF 2015 JUDGMENT: (Per Hon'ble Sri Justice R. Subhash Reddy) This appeal is filed by the respondents in W.P.No.27372 of 2015 aggrieved by the order, dated 27.08.2015, as extended by order, dated 28.09.2015, passed by the learned single Judge in the said Writ Petition.

Respondent is working as Field Assistant on contract basis in District Water Management Agency. By order, dated 14.08.2015, her contract was terminated on the ground that she has not achieved the prescribed percentage of target. Questioning the same, she has filed W.P.No.27372 of 2015 and this Court, by impugned order, dated 27.08.2015, granted interim directions, which were extended by order, dated 28.09.2015.

From a perusal of the material on record, it is clear that the order of termination, dated 14.08.2015, was passed only on the ground that the respondent has not reached the prescribed percentage of target and such order is questioned mainly on the ground that the respondent is not put on notice before passing the same. During the course of arguments, it is brought to our notice by the learned Advocate General appearing for the appellants that the appellants have filed W.V.MP.No.3570 of 2015 seeking to vacate the order, dated 27.08.2015, and the same is pending consideration. If

that be so, there is no reason to entertain the appeal at this stage. Accordingly, the appeal is dismissed leaving it open to the appellants to pursue W.V.MP.No.3570 of 2015.
