THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Civil Miscellaneous Appeal No.454 of 2012 JUDGMENT:
As there was no representation for the appellant on 02.06.2015, the matter was directed to be listed on 09.06.2015 under the caption 'For Dismissal'.
On 09.06.2015, it is submitted by the learned counsel for the appellant that he has no instructions. Therefore, the matter was directed to be listed after two weeks. The appeal came up for hearing today. When the appeal is taken up for hearing, the learned counsel for the appellant would submit that he has no instructions from the appellant. The appellant is called absent. It indicates that the appellant is not interested in prosecuting the matter.
Accordingly, the Civil Miscellaneous Appeal is dismissed for nonprosecution. There shall be no order as to costs. Miscellaneous petitions, pending if any, in this appeal shall also stand dismissed.
