THE HONOURABLE SRI JUSTICE T.AMARNATH GOUD MACMA No.2651 OF 2009 JUDGMENT:
This appeal is filed by the injured claimant being dissatisfied by the order dated 23.09.2002 in O.P.No.733 of 2001 passed by the Motor Accidents Claims Tribunal-cumPrincipal District Judge, Nalgonda, for enhancement of compensation.
The accident occurred on 24.01.2001, when the petitioner was traveling in a lorry bearing No. ADB 396 at Miryalaguda, near Ghanapuram gate, when the driver of the lorry drove it in a rash and negligent manner, it turned turtle, for which the petitioner and other inmates of the lorry received multiple injuries and they were treated in Government Hospital, Devarakonda.
On considering the oral and documentary evidence available on record, the tribunal granted compensation of Rs.15,000/.
Learned standing counsel for the insurance company submitted that the order passed by the tribunal is well considered and needs no interference of this Court and that since the appeal filed by the insurance company is disposed following the decision of the apex Court in National
Insurance Company Limited v Baljit Kour and others1, this appeal may be dismissed.
Having regard to the facts and circumstances of the case and in the light of the above decision, this appeal is dismissed. There shall be no order as to costs. Miscellaneous petitions, if any, shall stand closed. _______________________ T.AMARNATH GOUD,J Date: 01.10.2019 kvrm 1 2004 ACJ 448
