HONOURABLE SRI JUSTICE CHALLA KODANDA RAM W.P.No.23547 of 2019 ORDER:

Heard the learned counsel for the petitioner as well as the learned Standing Counsel for respondent Nos.1 and 2. 2.

The petitioner alleges that respondent Nos.3 and 4 are making construction without obtaining any permission from the authorities concerned. On the complaint given by the petitioner, the respondents-Corporation informed that they have issued notice under Sections 452 and 461 of the GHMC Act, 1955 to the respondent Nos.3 and 4 in respect of the alleged construction, but the respondent Nos.3 and 4 approached the VII Junior Civil Judge, City Civil Court, Hyderabad, and obtained interim orders in O.S.No.1342 of 2019 for making constructions.

In that view of the matter, the 2nd respondent shall forthwith take necessary action by bringing all these facts to the notice of the learned VII Junior Civil Judge, City Civil Court, Hyderabad, with respect to statutory violation being committed by respondent Nos.3 and 4 under the guise of the interim orders and seek for vacating the interim order, and thereafter, take necessary action in accordance with law. Further, the petitioner can also approach the learned VII Junior Civil Judge, City Civil Court, Hyderabad and file an application seeking to vacate the interim

CKR,J W.P.No.23547 of 2019 orders granted in O.S.No.1342 of 2019 and as and when such application is filed, the VII Junior Civil Judge, City Civil Court, Hyderabad, shall pass necessary orders within two weeks. 4.

With the above observations, the Writ Petition is disposed of. No costs.

Miscellaneous petitions pending in the Writ Petition, if any, shall stand closed.
