Smt. Uppatholla Soubhagyavathamma v. The District Collector

THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.11863 OF 2012 ORDER:

This writ petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue a writ or order or direction more particularly one in the nature of writ of mandamus, challenging in action of the respondents 1 to 3 in not taking any action against the respondents 4 to 6 pursuant to the complaints dated 09.01.2012 before the 1st respondent and 17.01.2012 before the 2nd respondent is illegal, arbitrary, high handed and violation of principles of natural justice and against the violation of Articles 14, 20 & 300-A of Constitution of India, and pass such other order or orders as this Hon'ble Court may deems fit and proper in the circumstances of the case ."

When the matter is called today, written instructions dated 25.04.2012, furnished by the Sub-Inspector of Police, Bhadrachalam Town Police Station, Khammam District, have been placed on record by the learned Government Pleader for Home and the said instructions read as under:

"It is submitted that, the petitioner had lodged a complaint on 26.12.2011 with the SHO Bhadrachalam Town Police Station, stating that, on 25.12.2011, the 4th and 5th respondents i.e., Uppatholla Goutham Kumar and Uppatholla Phanindra Kumar have trespassed into her house and threatened her with dire consequences and she requested to take necessary action.

Basing on the said complaint a case in Cr.No.271/2011 U/s. 448, 506 r/w. 34 IPC had been registered on 26.12.2011 against the respondents 4 and 5, as A-1 and A-2 on the file of Bhadrachalam Town P.S. Khammam District and took up investigation.

During the course of investigation as many as four witnesses including the complainant had examined and their detailed statements were recorded. Lws-2 to 4 have

corroborated the contents of FIR.

It is submitted that, on 3.1.2012, A-1 and A-2 have surrendered on 3.1.2012 before the Hon'ble Judicial First Class Magistrate Bhadrachalam and enlarged on bail. After completion of investigation, the charge sheet was filed U/s. 448, 506 r/w. 34 IPC before the concerned Court on 20.4.2012 and the C.C. number is awaited."

3. In view of the said instructions and further developments as mentioned therein, no further adjudication requires to be taken in the writ petition.

4. Accordingly, the writ petition is closed. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs.
