THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 46521 of 2016 ORDER:

This writ petition was filed challenging the action of respondent No.3-Sub-Inspector of Police, Kovur Police Station in registering FIR No.219 of 2016, dated 20.12.2016, on the complaint lodged by respondent No.4.

Respondent No.4 is aged about 92 years and is related to the petitioners. He lodged complaint, dated 20.12.2016, against the petitioner in connection with the misuse of his fixed deposits. A reading of the complaint discloses that there is a prima facie case for registration of the crime, and hence, the same cannot be quashed. However, since the matter is under investigation, respondent No.3 shall conduct the investigation only in accordance with law by duly following the provisions of Section 41 (A) Cr.P.C. The writ petition is accordingly disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
