HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 38014 of 2016 ORDER:
1) Heard learned counsel for the petitioner and Government Pleader for Revenue. With the consent of both the parties, the writ petition being heard at the admission stage itself. 2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent Nos.2 to 4 in not considering the petitioner's representations dated 02.05.2015, 07.09.2015 and 21.09.2015, as illegal, arbitrary and violative of articles 14 and 300-A of the Constitution of India; and consequently direct the respondents to consider the representations forthwith.
3) The grievance of the petitioner appears to be that though he made several representations for canceling the pattadar pass books and title deeds issued to Maddireddy Kasi Reddy and Maddireddy Venga Reddy, the respondents did not take any action till date.
4) The Government Pleader for Revenue submits that the District Collector is the competent authority to consider the request of the petitioner.
5) Having regard to the above, the writ petition is disposed of, directing the petitioner to make a fresh application before the Collector concerned seeking cancellation of pattadar passbooks and title deeds issued in favour of Maddireddy Kasi Reddy and
Maddireddy Venga Reddy, within a period of two (02) weeks from today. If the said application is made in accordance with the procedure contemplated under law, the Collector shall pass orders within six (06) weeks thereafter. There shall be no order as to costs.
6) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
