HON'BLE SRI JUSTICE A.RAJASHEKER REDDY C.S.No.2 of 2015 JUDGMENT:

Learned counsel for the plaintiff submits that the matter is settled out of the Court as the 2nd defendant undertakes to pay the amount in three installments. Out of them, two installments have already been paid and third installment is due on 29-02-2016.

In view of the same, learned counsel seeks permission of this Court to withdraw the suit with liberty to institute fresh suit, if the 2nd defendant fails to make the payment of the third installment.

Learned counsel appearing for the defendants stated no objection. Accordingly, the suit is dismissed as withdrawn granting liberty as prayed for. Interim order, dated 17-12-2015, passed in Application No.1477 of 2015 stands dissolved. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
