ORDER:

This contempt case is filed alleging willful disobedience of the order, dated 18.12.2014, in W.P.No.26406 of 2014. Respondent No.1 has filed a counter-affidavit, wherein he has, inter alia, stated that in order to comply with the order of this Court, he has sent letter/memo, dated 29.01.2015, to the Chief Engineer, North Coast, Visakhapatnam, to take necessary action as per the order of this Court. That thereupon, necessary proposals have been submitted by respondent No.2 to the Chief Engineer, Water Resources Department, North Coast, Visakhapatnam, vide letter, dated 13.03.2015, with a request to him to recommend the same to respondent No.1 and obtain necessary approval from the Government to intimate the nominal cost of the dilapidated quarters site to the petitioners.

That in turn, the Chief Engineer, North Coast, Visakhapatnam, addressed respondent No.1, vide letter, dated 24.03.2015, with a request to him to accord necessary approval from the Government to intimate the nominal cost. Respondent No.1, enumerating the further measures taken at different levels, averred that to complete the entire process in various departments and the file to be circulated to the Cabinet through the Chief Secretary, some more time is required for implementation of the order of this Court. After the filing of the counter-affidavit, respondent No.1 filed W.P.M.P.No.36980 of 2015 in W.P.No.26406 of 2014 seeking extension of time. This Court, by order, dated 09.09.2015, extended the time by eight weeks for implementation of the order of this Court. Learned Government Pleader for Irrigation and Command Area

Development submitted that the respondents will implement the order of this Court before the expiry of the extended time of eight weeks and requested for closing the Contempt Case.

In the light of the above subsequent events and by placing on record, the undertaking given by respondent No.1 in his counteraffidavit and by the learned Government Pleader at the hearing today, the Contempt Case is closed.
