HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.41354 OF 2016 ORDER:

The prayer in the Writ Petition reads as follows:- " To issue appropriate writ or order or direction more particularly one in the nature of writ of Mandamus, declaring the inaction of the respondent in not paying the old age pension @ Rs.1000/ - p.m. to the petitioner regularly as wholly illegal, arbitrary and in violation of principles of natural justice and consequently to direct the respondent No.4 to pay the arrears of the old age pension @ Rs.1000/ - from June, 2015 till date to the petitioner and continue the same in the interest of justice and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Heard the learned counsel for the petitioner and also the learned Standing Counsel for the 4th respondent offering to file vakalath and seek instructions and the learned Govt. Pleader for Panchayat Raj, representing other official respondents 1 to 3 and 5 and perused the prayer in the Writ Petition, supporting affidavit and other material on record.

The grievance of the petitioner is that despite of his representation to his entitlement to family pension of Rs.1,000/ - (one thousand rupees only) per month, the respondents are not paying same to him.

Having regard to the above, the respondents are directed to consider the representation of the petitioner pending with the respondents with a direction to the petitioner to give fresh representation within one week from the date of receipt of the

order and the respondents to pass appropriate orders subject to the eligibility.

As a sequel, miscellaneous petitions if any pending in this Writ Petition shall stand closed.
