THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE NO.270 OF 2017 ORDER: {Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan} The order, violation of which is alleged in the Contempt Case, was passed by a Division Bench of this Court in PIL.No.285 of 2015 dated 28.03.2016 wherein, among others a direction was issued to the Principal Secretary to the Government, Higher Education Department to take immediate steps to allocate Ac.1.00 of land to the Government Junior College (Girls) Kurnool. This Contempt Case is filed alleging non-compliance of this direction.
An affidavit is now filed enclosing thereto a copy of the memo dated 15.06.2017 issued by the Special Chief Secretary and a map. The memo dated 15.06.2017 records that the Government had allotted vacant land of Ac.1.00 for construction of KVR Junior College (Girls), Kurnool. While Sri K.P.Abhi Ram, learned counsel for the petitioner, would find fault with the place where the land is earmarked for the Girls Junior College, these are all matters which are extraneous to these contempt proceedings where the enquiry is limited only to ascertain whether or not the order of this Court has been violated; and, if so, whether the violation is wilful and deliberate.
As the order in PIL.No.285 of 2015 dated 28.03.2016 has been complied with, we see no reason to proceed against the respondents under the Contempt of Courts Act, 1971. The Contempt Case is, accordingly, closed.
