THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 1290 OF 2007 O R D E R:

The case of the petitioner is that he submitted the representation dated 02.11.2006 seeking enrolment in the 3rd respondent Sri Veda Sastra Smarta Pandita Parishad Society, but so far, no action has been taken thereon. Hence, this Writ Petition.

A counter-affidavit has been filed by the 1st respondent District Cooperative Officer, Guntur stating that the 3rd respondent Society is not a Society registered under the Andhra Pradesh Cooperative Societies Act, 1964, but under the Andhra Pradesh Societies Registration Act, 1969, with Registration No. 59 of 1969. Inasmuch as the 3rd respondent is a private society, the provisions of the 1964 Act have no application and hence, Respondents 1 and 2 are not competent to direct the 3rd respondent in any manner. In view of the submissions made in the counter-affidavit, learned counsel for the petitioner requests that his client may be given liberty to work out the remedies in accordance with law. Recording the said submission, the Writ Petition is closed, leaving liberty to the petitioner to work out the remedies available to him in accordance with law. No costs.

Consequently, the miscellaneous applications, if any shall also stand closed.
