When the matter was called on 12.12.2017, there was no representation for the petitioner, as such, this Court directed the matter to be listed under the caption 'for dismissal'. Even today, when the matter is called, none appears for the petitioner.

Hence, the petition is taken up for disposal on merits. 3.

This Criminal Petition is filed seeking for quash of the proceedings against the petitioner, who is accused in C.C. No.547 of 2010 on the file of I Additional Judicial Magistrate of First Class, Khammam. 4.

A perusal of the complaint would show that the complainant joined in the Indian Army on 10.05.1963 and, later, he was discharged from service on 11.05.1969, on the ground that his services were no longer required. The accused, for the reasons best known to him, raised the issue of status of Ex-servicemen of the complainant at the instance of one C.S.V. Vidya Sagar, and also gave frequent memos to surrender the Exservicemen identity card and also threatened the complainant with dire consequences and also gave a news item, imputing the reputation of the complainant in the society at large, which got published in the Telugu daily newspapers of Andhra Jyothi, Eenadu and Vaartha of Khammam district editions.

The news item published in the newspapers was that the complainant cheated the Army Officer and obtained identity card and the accused also cautioned the people of Khammam district stating that there is every possibility and likelihood of the complainant deceiving the people of Khammam and further stated that there is no connection between the Zilla Zainik Welfare Office, Khammam, with the complainant.

Hence, from the above contents, it appears that there is a primafacie material attracting the alleged offence against the accused. Hence, the Criminal Petition is dismissed. Interim stay granted by this Court on 23.08.2011 in Crl.P.M.P. No.7682 of 2011 shall stand vacated. As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
