THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41606 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the third respondent in interfering with the day-to-day activities of the petitioner by way of visiting day-in and day-out and threatening to implicate in false criminal cases as illegal and arbitrary, and consequently, to direct the second respondent herein to take action against the third respondent for interfering with the activities of the petitioner without any valid reasons. Heard and perused the material.

Learned counsel for the petitioner submits that the third respondent is interfering with the personal affairs of the petitioner and is threatening the petitioner to implicate him in criminal cases. Hence, he seeks a direction to the second respondent to take action against the third respondent and also direct the third respondent not to interfere with the day-to-day activities of the petitioner.

Learned Assistant Government Pleader for Home (Telangana) submits that the third respondent is not interfering with the affairs of the petitioner. Considering the rival submissions of the learned counsel for the petitioner and the Assistant Government Pleader for Home (Telangana), and also considering the facts and circumstances of the case, the third respondent is directed not to interfere with the affairs of the petitioner and also not to threaten the petitioner in any manner. The third respondent is also directed to follow due process of law laid down in Code of Criminal Procedure. The writ petition is accordingly disposed of.
