HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.19301 of 2004 ORDER:
This writ petition is filed seeking to issue a writ of mandamus declaring that the depot level seniority list prepared by the Depot Manager is illegal and contrary to Rule 3 of APSRTC Service Regulations, and also declaring the notice dated 09.10.2004 calling for options from drivers and conductors in respect of Kodad on the basis of the depot level seniority, as illegal and arbitrary. Learned counsel for the petitioners has contended that the respondents are not preparing the regional-wise seniority list as contemplated under the Service Rules and therefore appropriate orders may be passed directing the respondents to prepare the regional-wise seniority list instead of depot-wise seniority list.
Learned standing counsel for the respondents submits that the petitioners may be directed to submit a representation and on receipt of such representation, the respondents will pass appropriate orders. This Court having considered the submissions made by the parties is of the considered view that the writ petition can be disposed of directing the petitioners to submit a representation to the respondents within two weeks from the date of receipt of a copy of this order and upon receiving such representation the respondents shall consider and pass appropriate orders in four weeks thereafter.
With the above direction, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs. ______________________________ ABHINAND KUMAR SHAVILI, J 13th December, 2018 cbs
