When the matter is taken up, learned Government Pleader has placed on record the Order passed by the District Collector & Magistrate/ Election Authority, SPSR Nellore, vide Proc.No.718/ B/ 2016, dated 18.06.2018. The said order reads as under: - "Whereas Sri V.Gopi & other members of Fishermen Cooperative Society, Turupupundla (v) of Saidapuram (m) have represented in ref. read above that Sri K.Agrajayya, Ex-Secretary has illegally enrolled the Bogus members in the Admission Register of the Society without the notice of the President and accordingly the total membership increased from 41 to 87 in the Voters list and a case was registered with Station House Office, Saidapuram with FIR No.43/ 17 on 15-04-2017 on Sri K.Agrajayya, Ex-Secretary.

In view of the above, Sri M.L.Narisimham, Spl.Deputy Collector, T.G.P., Rapur Nellore is hereby appointed as Enquiry Officer to enquire into the issue of Bogus membership in Fishermen Cooperative Society, Turupupundla and to submit detail report. Keeping in view of the representation of Members pertains to Bogus membership, the election to the M.C. of the Fishermen Cooperative Society, Turupupundla to be held on 26.06.2018 is postpone to later date, which will be announced once the Enquiry Officer submits his report.

The Enquiry Officer has to enquire the following lapses as report by the J.D.Fisheries, Nellore.

1) The old records to be verified since its inception of the Society with regard to membership.

2) Whether the Enrolment of New members done as per guidelines or as per whims and fancies of Managing Committee.

3) A new admission register is prepared with members, whether the members are genuine or not.

4) Why the 87 members in Admission Register as displayed in Voters list by the Person-in-charge in the final voters list without observing the way they enrolled.

Therefore, the Enquiry Officer is requested to submit the detailed report at the earliest so as to take further action in the matter."

Having regard to the contents of the above orders, this Court deems it appropriate to dispose of the Writ Petition, by placing the same on record.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed. There shall be no order as to costs.
