HON'BLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION NO.23537 OF 2019 ORDER:

This Writ Petition is filed to declare the inaction of the 3rd respondent in initiating investigation in Crime No.307 of 2019 of P.S. Keesara, Medchal District, as being illegal and arbitrary.

Heard learned Counsel for the petitioner and learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, on written instructions dated 14.11.2019, submits that basing on the complaint of the petitioner, a case was registered in Crime No.307 of 2019 under Sections 406, 420, 506 read with 34 IPC of Keesara police station on 10.07.2019. Learned Assistant Government Pleader for Home further submits that upon registering the said case, the matter was investigated into and in the course of investigation, L.Ws-1 and 2 were examined and their statements were recorded. It is also stated that notices under Section 41-A Cr.P.C. were served to Accused Nos.2 to 4 on 29.07.2019, and in so far as accused No.1 is concerned, notice under Section 41-A Cr.P.C. is to be served. It is submitted that having regard to the nature of offences under which the case is registered, the authorities are taking efforts to collect information before

finalizing the report and filing the same before the concerned Court.

Having regard to the said submission made on behalf of the respondents, this Court is of the view that it cannot be said that the respondents have not acted upon the complaint made by the petitioner or the matter is not being investigated into, requiring interference by this Court.

In view of the above, no further orders are required to be passed in the Writ Petition, except observing that the authorities shall endeavour to investigate into the case as expeditiously as possible to take appropriate steps. Accordingly, the Writ Petition is closed. No order as to costs.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
