HON'BLE SRI JUSTICE T.AMARNATH GOUD W.P.No.23564 of 2019 ORDER:

This Writ Petition is filed to declare the action of the 7th respondent in not shifting the dumping yard from Sy. No.134/3 of Narsingi village, Gandipet Mandal, immediately adjacent to the bank of Musi river to the new alternate area in Sy. No.134/6 as directed vide proceedings dt.29-08-2018 as illegal and arbitrary. Heard the learned counsel for the petitioner and Sri Y.Rama Rao, learned Standing Counsel for 5th respondent. As directed by this Court by order dt.12-12-2019, the 7th respondent is present and placed the report dt.06-12-2019 before the Court.

In pursuance of the said report, wherein it is stated that the Girdawar, Gandipet Mandal, has reported that on 06-12-2019, she along with the Mandal Surveyor, Village Revenue Officer, Narsingi village, and Municipal officers have proceeded to the spot in Government land in Sy. No.134/6 of Narsingi village and once again demarcated the said land to an extent of Ac.1.00 gts and shown the boundaries to the Municipal officials and handed over the said land along with sketch under cover of Panchanama to the Panchayat Secretary, Narsingi Gram Panchayat, for usage of the same for the purpose of dumping yard.

In view of the same, nothing survives for adjudication in the Writ Petition. However, the 7th respondent shall consider shifting of the dumping yard as expeditiously as possible by working out his logistics.
