THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY APPEAL SUIT No.867 OF 1997 JUDGMENT:

Sri V.Parabrahma Sastri, learned counsel for the appellant, represented that he addressed a letter to the appellant on 29.01.2013 and the same was returned with an endorsement that "addressee died and hence returned to the sender". Thus, it is evident from the post card addressed to the appellant that the appellant died long back and no steps were taken to implead the legal heirs. Hence, the Appeal is abated by operation of law. Accordingly, the Appeal Suit is dismissed as abated, but without costs. Miscellaneous Petitions, if any, pending in this Appeal Suit shall stand dismissed.
