THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL APPEAL No.823 OF 2015 JUDGMENT:

This Criminal Appeal, under Section 378(4) of the Code of Criminal Procedure, 1973, is directed against the judgment, dated 28.5.2015, in C.C.No.2547 of 2012 on the file of the IX Metropolitan Magistrate, Cyberabad, Kukatpally at Miyapur whereunder and whereby, respondent No.2/accused was found not guilty of the offences punishable under Sections 341 and 326 I.P.C. and was acquitted under Section 248(1) Cr.P.C.

2. Heard and perused the material available on record.

3. It is to be seen that without even exhausting the remedy of filing an appeal before the Sessions Court concerned, the de facto complainant has directly approached this Court by way of filing the appeal. Hence, the appeal is not maintainable and is liable to be dismissed.

4. Accordingly, this Criminal Appeal is dismissed with a liberty to the de facto complainant to file an appeal before the Court concerned. Miscellaneous petitions pending, if any, in this Criminal Appeal shall stand closed.
