THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 17915 of 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for the respondents.

2. The petitioner is a Fair Price Shop Dealer of Shop No.1 of Dommaranandyala Village, Mylavaram Mandal, Kadapa District. The authorization is valid up to 31.03.2016. While so, the 3rd respondent issued proceedings dated 14.10.2014 accepting the purported resignation of the petitioner. Questioning the same, the petitioner approached this Court by filing W.P.No.37006 of 2014. This Court by an order dated 08.12.2014 closed the said writ petition along with three other writ petitions holding that as the 3rd respondent restored the authorizations, no direction in this regard need be issued. Later on, the petitioner was issued with a show cause notice on 19.03.2015 for which the petitioner submitted her explanation. After perusing the explanation, the 3rd respondent passed an order on 15.04.

2015 suspending the authorization of the petitioner for a period of three months pending enquiry. Against the said order, the petitioner preferred an appeal to the 2nd respondent along with a stay petition. As no orders are passed on the stay petition, the petitioner again approached this Court by filing W.P.No.14842 of 2015 and the same was dismissed on 21.05.2015 on the ground that the petitioner cannot be permitted to prosecute two parallel proceedings in respect of same cause of action. Thereafter, on 01.06.

the appeal directing the 3rd respondent to dispose of the case within four weeks. Challenging the same, the present writ petition is filed.

3. It is clear from the record that the authorization of the petitioner was suspended on 15.04.2015 only for a period of three months and the petitioner had already submitted her explanation. In the circumstances, the 3rd respondent is directed to complete the enquiry duly observing the principles of natural justice and pass final orders within a period of 30 days from the date of receipt of a copy of this order.

4. The Writ Petition is accordingly disposed of. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. There shall be no order as to costs.
