HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.7680 of 2017 ORDER:

Heard learned counsel for the petitioner/Accused No.1 in Crime No.1703 of of Rajendranagar Police Station, Cyberabad, registered for the offence punishable under Section 420 IPC and also learned public prosecutor representing the respondent-State and perused the FIR and grounds urged in the quash petition.

2) Though several contentions raised impugning the very sustainability of crime registered for the offence punishable under Section 420 IPC including as there is already a civil dispute pending between the parties, there is nothing to interdict the investigation but for to say the petitioner shall not be arrested, leaving open all the defences. However, it is made clear that this will not preclude the police to secure the presence of the petitioner as and when required.

3) Accordingly, the Criminal Petition is disposed of, 4) Pending miscellaneous petitions, if any, in this Criminal Petition shall stand closed.
