THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION Nos.35809, 35834, 35838, 35857, 35864, 35865, 35874, 35876, 35887, 35893 and 35932 of 2015.

COMMON ORDER:

Since the issue involved in all these writ petitions is one and the same, they are being disposed of by way of a common order.

2. Case of the petitioners is that they have been granted 'D' form pattas in various extents of lands situated in Unikilli Village, Mandavalli Mandal, Krishna District in the year 1985 and pattadar pass books and title deeds have been issued in their favour and all of them have been cultivating the said lands by converting the same into fish tanks with the prior permission of the Mandal Revenue Officer and they have not leased out or alienated the said lands in favour of any third persons. While so, after serving notices and after considering the explanation of the petitioners, orders have been passed for resumption of the lands of the petitioners in Rc.No.187/2007, dated 12.10.2007, by respondent No.4. Aggrieved by the said orders, the petitioners have filed an appeal before respondent No.3, which is stated to be pending.

Complaining inaction on the part of respondent No.3 in disposing of the appeal, W.P.No.22628 of 2007 was filed by the petitioners before this Court and the same was disposed of on 26.10.2007 directing respondent No.3 to dispose of the appeal as expeditiously as possible. The petitioners also filed W.P.Nos.15649 of 2009 and 10541 of 2012 before this Court and the same were also disposed of by way of a common order on 25.6.2012 with a direction to respondent No.3 to consider and dispose of the appeal expeditiously, preferably within a period of three months from the date of receipt of a copy of that order.

3. Learned counsel for the petitioners states that even now, the appeal is not disposed of by respondent No.3 though several years have elapsed.

4. The non-compliance of the order of this Court by respondent No.3 herein cannot be approved. Therefore, there shall be a direction to respondent No.3 to forthwith fix

a date, after notice to petitioners, and hear and dispose of the said appeal on or before 31.12.2015. The petitioners are at liberty to bring the non-compliance of the order, if any, to the notice of this Court.

5. Insofar as the petitioners' claim for a direction to respondent Nos.3 and 4 regarding dispossession is concerned, the instructions of the learned Government Pleader show that the lands mentioned in the writ petitions were already taken possession by the Mandal Revenue Inspector, Mandavalli on 23.10.2007. In view of that, I am not inclined to grant any order relating to the dispossession as prayed for by the petitioners.

6. Accordingly, all the Writ Petitions are disposed of. There shall be no order as to costs.
