ORDER:- Heard learned counsel for the petitioner; learned government pleader for Land Acquisition appearing for respondent Nos.1 and 2; and Mr.Vivek Reddy, learned counsel appearing for respondent Nos.3 and 4.

2. The award enquiry regarding the acquisition of petitioner's land is stated to be pending with the third respondent and the petitioner states that along with the claim petition they have filed documents including the extract of basic value register in support of the market value under the Indian Stamp Act and seek adoption of that by the third respondent while passing the award. However, as on today, the award is not yet passed and the apprehension of the petitioner is that the third respondent may not follow the value under basic value register.

3. In my view, as on today, the writ petition is purely speculative as it cannot be said, as to whether the third respondent will adopt that value or not. It is evident that, as on today, it is for the third respondent to determine the market value in terms of Act 30 of 2013 by taking into consideration appropriate documents.

The Mandamus, as sought for, cannot be granted. Hence, the writ petition is dismissed. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs. _____________________ VILAS V. AFZULPURKAR, J August 26, 2015 LMV
