THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1520 OF 2016 ORDER:

This Criminal Revision Case is preferred challenging the order, dated 9.5.2016, in Crl.M.P.No.927 of 2016 in Crime No.199 of 2016 on the file of the II Metropolitan Magistrate (For Railways), Secunderabad.

2. The offences alleged against the petitioner are punishable under Section 379 read with 511 I.P.C.

3. The petitioner filed Crl.M.P.No.927 of 2016 before the trial Court under Section 219 Cr.P.C. seeking to order for return of his original Employment Identity Card. V i d e impugned order, the trial Court dismissed the said application holding that the same cannot be returned until the trial is completed. Challenging the same, the present Revision is filed.

4. Learned counsel for the petitioner submitted before this Court that the Employment Identity Card of the petitioner seized in the aforesaid crime is very much required to the petitioner, as he is rendering his services in Army, and without the Identity Card, the petitioner will not be allowed to attend to his duties.

5. Heard and perused the material available on record.

6. Considering the facts and circumstances of the case, the Station House Officer concerned is directed to release the Employment Identity Card of the petitioner seized in the above crime to the petitioner on condition of his executing a personal bond for a sum of Rs.5,000/- (Rupees five thousand only) with one surety for the like sum to the satisfaction of the II Metropolitan Magistrate (For Railways), Secunderabad and also on production of zerox copy of the said Employment Identity Card.

7. Accordingly, the Criminal Revision Case is disposed of.

8. Miscellaneous petitions pending, if any, in this Criminal Revision Case shall stand closed.
