Heard learned counsel for the petitioner and learned Government Pleader for Revenue for respondents. 2.

This writ petition is filed alleging that application filed on 16.04.2019 for conducting of survey of land to an extent of Ac.3.15 guntas in Sy.No.269, of Gopanpally Village, Serlingampally Mandal, Ranga Reddy District, is not considered and so far survey is not conducted.

When the case was taken up for consideration, learned Government Pleader produced photocopy of the Memo File No.MS/96/2019 dated 18.07.2019 signed by the Deputy Collector & Tahsildar, Serlingampally Mandal, informing the petitioner that as reported by Mandal Surveyor demarcation of land in Sy.No.269 of Gopanpally Village cannot be considered as the said survey number is having "District boundary dispute (Takrari land)".

Though learned counsel for the petitioner sought to contend that it is not an order but it is in the form of a memo, a reading of the said memo would show that a decision not accepting the request of petitioner for conducting of survey with the reason mentioned above is made and communicated. Therefore, it cannot be said that it is not a decision, though it could not have been in the form of a memo. A copy of the said memo is served on learned counsel for the petitioner. Against

- 3 - the decision of Tahsildar, remedy of appeal is available before the Revenue Divisional Officer.

At this stage, learned counsel for the petitioner seeks leave of the Court to prefer appeal against the said decision. 6.

Granting the leave as sought for, the Writ Petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed.
