THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 17842 of 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for the respondents.

2. The petitioner was appointed as a Fair Price Shop Dealer of Shop No.3 of Abdullapuram Village, Kolimigundla Mandal, Kurnool District, in the month of January, 2015. While so, the 4th respondent visited the shop and noticed certain irregularities and submitted a report dated 18.03.2015, pursuant to which, the 3rd respondent issued a show cause notice on 24.12.2014. However, on 30.04.2015 he suspended the authorization pending enquiry. Challenging the same, the petitioner preferred an appeal before the 2nd respondent on 29.05.2015 along with a stay petition of even date. When the same is not disposed of, the present writ petition is filed.

3. In view of the petitioner preferring an appeal against the impugned order dated 30.04.2015 passed by the 3rd respondent, this Court is not inclined to consider the validity or otherwise of the said order. However, since the petitioner had already filed an appeal along with a stay petition, the 2nd respondent is directed to consider the stay petition filed on 29.05.2015 and dispose of the same within one week from the date of receipt of a copy of the order.

4. The Writ Petition is accordingly disposed of. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 19th June, 2015
