HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.364 of 2017 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking to declare the action of the respondent authorities in trying to cancel the D-Form patta of the petitioner pertaining to land admeasuring Ac.0-24 cents situated in survey No.82/1A of Malkipuram Village and Mandal, East Godavari District, as illegal and arbitrary.
Heard learned counsel for the petitioner and Assistant Government Pleader for Revenue. With their consent, the writ petition is disposed of at the admission stage itself. The main contention of the petitioner is that the respondent authorities are trying to dispossess the petitioner from the subject land without following due process of law.
Learned AGP would submit that any action by the authorities would only be in accordance with law. Having regard to the rival submissions made, the Writ Petition is disposed of directing the respondent authorities not to dispossess the petitioner from the land admeasuring Ac.0-24 cents in survey No.82/1A situated at Malkipuram Village and Mandal, East Godavari District, without following due process of law. Miscellaneous petitions pending in this petition, if any, shall stand closed. No order as to costs.
