I.A.No.1 OF 2026 This application is filed praying this Court to relax the condition No.i of the order dated 20.09.2022 passed in Crl.P.No.6656 of 2022 which reads as under:
" The petitioners shall appear before the concerned Investigating Officer, Enforcement Directorate, at Hyderabad for the purpose of questioning/interrogation on 26.09.2022 at 10:00 A.M and surrender his passport".
Heard both sides.
Learned counsel for the petitioner submits that the earlier the petitioner has filed I.A.Nos.1 to 3 of 2025 wherein this Court ordered directed the petitioner to surrender his passport before the concerned Investigating Officer, Enforcement Directorate, at Hyderabad for a period of two months. It is further submitted that the petitioner herein filed Quash petition vide Crl.P.No.5766 of 2025 wherein this Court stayed the proceedings vide order dated 13.04.2025 and that being so, there is no question of conducting investigation till the disposal of the said quash petition, as such, while averring that the petitioner is ready to co-operate with the Investigating Officer, he prayed this Court to return the passport and permit the petitioner to travel abroad for a period of one year, i.e., the
period between 21.02.2026 to 20.02.2027, precisely as and when required. Therefore, he prays for relaxation of the said condition.
On the other hand, Ms. K. Pranathi, learned counsel representing Mr. D. Narender Naik, learned counsel for the respondent submits that in case of this Court granting the relevant relief to the petitioners as sought for, certain conditions may be imposed.
In the said circumstances, this Court is inclined to relax the condition imposed against the petitioner in Crl.P.No.6656 of 2022 dated 20.09.2022 and directing the trial Court to return the passport of the petitioner herein for a period of one
(01) year i.e., from 21.02.2026 to 20.02.2027 and permitting him to travel abroad during the said period in compliance of the following conditions:
i) The petitioner shall file sworn affidavit before the Investigating Officer by furnishing the travel particulars including his place of stay and his contact details.
ii) The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only), with two sureties for a like sum each to the satisfaction of the concerned Investigating Officer.
iii) The petitioner shall report his presence before the concerned Investigating Officer, within one week
from the date of his return to India.
iv) The petitioner also shall file an affidavit that he will abide by the above conditions before the concerned Investigating Officer.
Accordingly, this application is ordered.
