THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2588 of 2016 ORDER:

This Criminal Petition is filed by the petitioners-A.1,A.2 and A.5 under Section 482 Cr.P.C., to quash the proceedings in FIR No.44 of 2016 on the file of Nacharam Police Station, Cyberabad for the offences under Sections 420, 406, 468, 471, 474 of IPC.

Heard.

On perusal of the entire material available on record, prima facie there are some allegations as against the petitioners and truth or otherwise of the said allegations can be ascertained by the investigating agency during the course of investigation and this Court is not inclined to quash the proceedings in the said crime at this stage. However, the complainant filed a private complaint before the XIII Metropolitan Magistrate, Hayathnagar, R.R.District under Section 200 Cr.P.C. and the learned Magistrate referred the said complaint to the police under Section 156(3) Cr.P.C. without following the procedure contemplated.

In view of the above, the police concerned are directed to complete the investigation into the crime without arresting the petitioners herein and file a final report, if any, in accordance with law. The petitioners are directed to appear before the investigating agency as and when required and cooperate with the investigating agency.

Accordingly, the Criminal Petition is disposed of. Miscellaneous Petitions filed in this Criminal Petition, if any, shall stand closed.
