THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 23567 of 2019 ORDER:

In this Writ Petition, petitioners challenge the action of the second respondent - District Prohibition & Excise Officer, Bhadradri Kothagudem District, in allotting shop No.3 in favour of the sixth respondent without there being any resolution passed by Gram Sabha of either Tekulapalli or Dasu Thanda. Heard learned counsel for petitioners and learned Government Pleader for Prohibition & Excise appearing for respondent Nos.1 to 5.

From a perusal of the resolutions passed by Dasu Thanda and Tekulapalli Gram Panchayats, as produced before this Court by the learned Government Pleader for Prohibition & Excise appearing for respondent Nos.1 to 5, it is evident that the respective Gram Panchayats have passed resolutions with respect to establishment of two wine shops in each of the Gram Panchayats.

In those circumstances, there is no merit in the Writ Petition, which is accordingly dismissed.

Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
