ORDER
This petition under Section 482 Cr.P.C. is filed by the petitioners/A1 to A4 seeking to quash the proceedings in Cr.No.39 of 2016 of Guntakal II Town Police Station, Anantapur District, registered for the offences punishable under Sections 160, 353 r/w 34 IPC, against them.
2. It is alleged in the complaint that while the de facto complainant was working as Constable in Guntakal II Town Police Station, on 29.03.2016, one person, by name, K. Nagarjuna, came to the Police Station and complained that his elder brother, his sons and his younger brother beat him with hands and legs at the Sub-Registrar's Office in connection with the sale of house, and on that complaint, when the de facto complainant was enquiring about the public nuisance caused by two groups at the said office, the accused obstructed him, pushed him down and prevented him from doing his duties. Based on the complaint, the aforesaid crime was registered against the accused.
3. The allegations in the complaint are not so serious in nature. However, truth or otherwise of the allegations made against the petitioners/A1 to A4 can be ascertained by the investigating agency during the course of investigation. Therefore, this Court is not inclined to interfere with the impugned proceedings. However, the police concerned are directed to complete the investigation without arresting the petitioners/A1 to A4 and file a final report, if any, in accordance with law. The petitioners/A1 to A4 are directed to appear before the investigating
agency as and when required and cooperate with the investigating agency.
4. With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this petition shall stand closed.
