HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CIVIL REVISION PETITION No.677 of 2011 ORDER :

Heard both sides.

Undisputedly, against the dismissal of the claim petition, a regular appeal is maintained and is pending on the file of Principal District Judge, Eluru and the petitioner obtained an order dated 01.03.2011 in I.A. No.3100 of 2010 in the pending appeal and thereby, no further adjudication in the revision is required.

Accordingly, the revision is disposed of without prejudice to the rights of the revision petitioner in the appeal so also in the interim order in the appellate Court given direction to the executing Court. There shall be no order as to costs. Pending miscellaneous petitions, if any, shall stand closed.
