ORDER:

This writ petition is filed with the grievance that respondent No.6 is trying to use Ac.0.30 cents of land belonging to the Government and situated adjacent to the petitioner's patta land, as dumping ground pending her application made to respondent No.3 for allotment of the said land. In my opinion, this writ petition is wholly misconceived for the reason that the petitioner who claims to be in occupation of the Government land has no vested right

for allotment of the same. Unless the land was allotted to the petitioner, she cannot seek to prevent the Gram Panchayat concerned from using the land for a public purpose, namely, dumping the garbage. If at all, the grievance of the petitioner lies against the Revenue Department for not disposing of her application. Instead of seeking relief in this direction, the petitioner has claimed relief against respondent No.6.

For the above mentioned reasons, the writ petition is dismissed. As a sequel to dismissal of the writ petition, W.P.M.P. No.45763 of 2015 shall stand disposed of as infructuous.
