HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No. 21942 OF 2016 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard Sri Deepak Mishra, learned counsel for the petitioner; Sri Y. Ravindra, learned counsel for respondent No.1 and learned Government Pleader for Revenue for respondent No.2. The petitioner challenges the order dated 01-06-2016 passed by Lokayukta in Complaint No.267/2016/B2 filed by respondent No.3. The petitioner is not a party to the complaint. He submits that respondent No.3 while filing the complaint suppressed material facts from respondent No.1 including the fact that civil litigation is pending between him and respondent No.3 and that he has obtained interim order in the suit.

Since the complainant did not make him party, he submits, that the Lokayuktha passed the impugned order assuming that whatever has been stated in the complaint is true.

"The petitioner shall make an application seeking recall of the order dated 01-06-2016 and seek dismissal of the complaint on all grounds including the ground of jurisdiction. We are keeping all contentions of the parties open. It is needless to mention that if there exists any order passed by civil Court protecting the petitioner's interest, the revenue authorities shall not dispossess him on the basis

of the order dated 01-06-2016 impugned in the present writ petition, during pendency of the complaint before the Lokayuktha." With these observations, writ petition is disposed of.
