HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.6317 of 2018 ORDER :

The petitioner is the sole accused in Crime No.72 of 2018 on the file of the Ghanpur (W) Police Station, Jangaon District. The crime registered is for the offences punishable under Sections 498-A & 306 IPC for the occurrence taken place on 16.04.2018.

The deceased is no other the wife of petitioner-accused. So far ten witnesses are examined including the children of deceased and accused as LWs 3 and 4. A perusal of the F.I.R. and the statements of witnesses, particularly of LWs 3 and 4, prima facie attracts the offence under Section 306 IPC from one of the three limbs of Section 107 IPC. In view of the prima facie accusation and even the accused is in judicial custody since 15.05.2018, there are no grounds to grant the concession of bail to the petitioner at this stage. Accordingly, this Criminal Petition is dismissed.

However, it will not prevent the petitioner-accused to renew the request from changed circumstances in future. Miscellaneous petitions pending, if any, shall stand closed.
