THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.20514 of 2018 ORDER:

Apprehending dispossession from the plots described in the writ prayer, without recourse to law pending consideration of regularization, the petitioners have filed the instant writ petition.

The petitioners refer to field inspection by subordinate officers of respondent Nos.4 and 5.

At request of respondents, time was granted on 20.06.2018 for getting instructions on the threatened dispossession of petitioners from petition plots.

Respondent No.5 places before the Court, the written instructions dated 20.06.2018 together with annexures showing the present state of enjoyment not only by petitioners but also by other hut dwellers in Sy.No.96/1 at Nagole village. The request for regularization is pending consideration by the competent authority.

With regard to possession of petitioners, this Court is of the view that their possession shall not be altered or disturbed, pending consideration of the request of petitioners for regularization.

Hence, the writ petition is disposed of by this order by placing on record the written instructions dated 20.06.2018.

The respondents are directed not to dispossess the petitioners from the petition plots, till the respondents consider the request of petitioners for regularization and communicate orders to them. No order as to costs. Miscellaneous petitions, if any, pending, shall stand closed.
