HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition Nos. 18529, 18533 and 18535 of 2017 Common Order:
These three cases are being disposed of by this common order, as they were filed challenging the notices issued under Sections 452(1) and 461(1) of the Greater Hyderabad Municipal Corporation Act, 1955 for the alleged deviations to the sanctioned plans in respect of the houses constructed by the petitioners situated at Yashodamma colony, Kapra, Ranga Reddy district.
It is submitted by the learned counsel for the petitioners that after receipt of the notices as aforesaid the petitioners submitted their explanations on 24.05.2017 and the respondents are interfering and trying to demolish the structures without passing orders. In view of the allegation, this Court is inclined to dispose of the present Writ Petitions with a direction to the second respondent to consider the explanations submitted by the petitioners to the show cause notices issued and pass appropriate orders in accordance with law and till then no action for demolition of the structures shall be taken. The Writ Petitions are, accordingly, disposed of. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions pending in these Writ Petitions, if any, shall stand closed.
