HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.3652 OF 2017 ORDER:

The case of the petitioners is that they preferred an appeal along with stay application before the 1st respondent on 12.02.2016 under Section 70 of the Chit Fund Act, 1982 vide Memo No.3012/Regn.I/A1/2016-1 against the Award passed by the 2nd respondent in Arbitration Claim Petition No.605 of 2014 dated 05.09.2015. As no orders are passed either in the appeal or stay application, the present writ petition is filed.

Learned counsel for the petitioners submits that pending the appeal before the 2nd respondent, the 3rd respondent is trying to execute the impugned Award dated 05.09.2015.

Heard the learned Assistant Government Pleader for Revenue.

In view of the above facts and circumstances, the writ petition is disposed of directing the 1st respondent to dispose of the stay application filed along with appeal vide Memo No.3012/Regn.I/A1/2016-1 dated 12.02.2016, within a period of four (04) weeks from the date of receipt of copy of this order. Till such time, there shall be stay of operation of the order passed by the 2nd respondent in Arbitration Claim Petition No.605 of 2014. There shall be no order as to costs.

As a sequel, miscellaneous petitions pending if any, shall stand closed.
