HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.34949 of 2012 ORDER:

This writ petition was filed challenging the action of the 1st respondent in not taking any action for removal of the compound wall constructed by the 2nd respondent in the land of the petitioner in Sy.No.96 situated at Maruthi Nagar, Mandamarri, Adilabad District.

This Court, while issuing notice on admission on 09.11.2012, held that the pendency of the writ petition will not disable the 1st respondent from taking into consideration the legal notice issued by the petitioner on 13.02.2012 and the representation dated 30.04.2012 and passing appropriate orders thereon.

Now, it is submitted by the learned Counsel for the 2nd respondent that when a notice was issued to the 2nd respondent under Section 228 (1) (2) of the A.P. Municipal Act, 1965, he preferred an appeal before the Special Officer, Mandamarri Municipality and the said appeal was allowed on 12.12.2013. 4.
In view of the above, no further orders are necessary in the present writ petition. The Writ Petition is accordingly dismissed as infructuous. No order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
